1. Acceptance of Terms By accessing the website bitfia.io or ipint.io (the “Site”) or using any services, APIs, or software provided by Bitfia Technologies Pte. Ltd. (“Bitfia”, “we”, “us”, or “our”), you (“User”, “Client”, or “you”) agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use our Services.
2. Description of Services Bitfia provides financial infrastructure technology, including the iPint payment gateway, which facilitates:
The acceptance of cryptocurrency payments for businesses.
The conversion of digital assets into stablecoins or fiat currency.
Cross-border B2B settlement and disbursement services.
We are a technology provider, not a bank. We do not offer interest-bearing accounts or traditional banking services.
3. Eligibility To use our Services, you represent and warrant that:
You are a legal entity or an individual at least 18 years of age.
You have the full power and authority to enter into this agreement.
You are not located in, or a citizen of, any jurisdiction where the use of our Services is prohibited by law (e.g., sanctioned countries).
You are not listed on any sanctions lists (such as OFAC, UN, or EU sanctions lists).
4. Account Registration & Security
4.1 Registration: You must register for an account to access the Services. You agree to provide accurate, current, and complete information during the registration process.
4.2 Security: You are responsible for maintaining the confidentiality of your account credentials (username, password, API keys). You agree to notify us immediately of any unauthorized use of your account. Bitfia is not liable for any loss or damage arising from your failure to protect your credentials.
5. Compliance (KYC/AML)
5.1 Identity Verification: To comply with Anti-Money Laundering (AML) and Counter-Terrorism Financing (CFT) laws, we require you to pass “Know Your Customer” (KYC) or “Know Your Business” (KYB) verification.
5.2 Documentation: You agree to provide us with any documents we request (e.g., passports, business licenses, UBO information). Failure to provide this information may result in the suspension or termination of your account.
6. Acceptable Use Policy You agree NOT to use the Services for any of the following prohibited activities:
Illegal Activities: Facilitating illegal gambling, drug trafficking, fraud, money laundering, or terrorist financing.
High-Risk Goods: Selling weapons, adult content, or counterfeit goods.
IP Infringement: Violating the intellectual property rights of Bitfia or others.
System Abuse: Attempting to compromise the security of our API, interfering with the proper working of the Site, or imposing an unreasonable load on our infrastructure (DDoS).
7. Fees and Payments
7.1 Fees: You agree to pay the fees for the Services as set forth in our Fee Schedule or your specific commercial agreement. Fees may be deducted automatically from your transaction proceeds.
7.2 Changes: We reserve the right to change our fees upon notice to you. Continued use of the Service after a fee change constitutes your agreement to the new fees.
8. Risk Disclosure
8.1 Volatility: While we settle in stablecoins/fiat, the underlying crypto markets are volatile. You acknowledge that Bitfia is not responsible for market losses incurred before a transaction is finalized.
8.2 Blockchain Risks: You understand that blockchain transactions are irreversible. If you send funds to the wrong address, we cannot recover them. You assume all risks associated with the use of blockchain technology.
9. Limitation of Liability To the maximum extent permitted by law, Bitfia Technologies Pte. Ltd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
Your access to or use of or inability to access or use the Services.
Any unauthorized access to or use of our servers and/or any personal information stored therein.
Any bugs, viruses, or trojan horses transmitted to or through our Services by any third party.
10. Indemnification You agree to defend, indemnify, and hold harmless Bitfia, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of or in any way connected with your access to or use of the Services or your violation of these Terms.
11. Termination We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Services will immediately cease.
12. Governing Law These Terms shall be governed and construed in accordance with the laws of Singapore, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be resolved by the courts of Singapore.
13. Changes to Terms We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
