Terms and Conditions of Use of Service for Bitfia and PINT Software
Please read these Terms and Conditions of Use ("Terms", "Terms and
Conditions") carefully before using the Bitfia website and the PINT mobile
wallet application/s (the “Service”, “PINT”), and any other application for
Android and iOS developed and released by Bitfia Labs Pte Ltd. Your access
to and use of the Service is conditioned on your acceptance of and
compliance with these Terms. These Terms apply to all visitors, users and
others who access or use the Service.
1. Parties
This agreement is between you ("You" or "Your" in this agreement) and Bitfia Labs Pte Ltd. ("Bitfia”, “us”, “we”).
2. Service Offered
Bitfia has created a software application that enables users to access, and
transfer virtual currencies, tokens, and cryptocurrencies (collectively,
“Digital Asset(s)”) under the name “PINT” (“PINT Software”). This license
agreement permits You to use the PINT Software subject to certain
conditions, rights and obligations.
You should only use the PINT Software if you are familiar with Digital
Assets. Bitfia highly recommends learning the basics for the Digital Assets
that You plan on using with the PINT Software before running the PINT
Software.
The PINT Software is licensed to you without charge. This agreement applies
to any technical support provided to You in relation to the PINT Software.
3. You Own Your Private Keys
Bitfia does not store any private keys, backup phrases or passwords
(collectively, “Private Key Information”). Private Key Information is
stored locally in Your mobile device. It is very important that You backup
Your Private Key Information. If You lose Your Private Key Information then
it will not be possible for Bitfia to recover it for You and You may
permanently lose access to Your Digital Assets.
PINT software shall give
you an option of backup using a Industry leading solution of Backup phrase
as used in HD Wallets.
If You do not understand the above paragraph then Bitfia recommends that
You learn more about Digital Assets before using the PINT Software.
4. User Obligations
You shall:
a. be of age of majority in Your local jurisdiction; and,
b. be responsible for Your own Digital Assets; and,
c. backup/write down Your “backup phrase” and keep it private; and,
d. carefully guard Your private keys; and,
e. carefully review the list of supported Digital Assets before engaging in any transactions; and,
f. ensure that Your device(s) are fully updated and do not contain viruses, malware or otherwise malicious software; and,
g. ensure that Your use of the PINT Software complies with Singaporean and local laws.
You shall not:
a. deposit Digital Assets into addresses for Digital Assets that are not supported by the PINT Software; or,
b. use the PINT Software in a manner likely to interfere with other PINT Software users or servers (e.g. excessive API calls or network spam); or,
c. use the PINT Software in a manner contrary to the laws of Singapore or Your local laws.
5. No Control Over Digital Assets
Bitfia is not the creator of, and does not have any control over, any of the Digital Assets that the PINT Software allows You to use. You shall be solely responsible for Your choice of and use of Digital Assets.
6. Third Party Services/Integrations
The PINT Software integrates with third party services.
Although the PINT Software makes it easy to engage with integrated third
parties, Bitfia shall not be responsible for any consequences resulting
from Your use of third party integrated services. If You require assistance
with a third-party integration then You should contact that third party.
We are not responsible for external sites or services
Hypertext links to external websites or services in no way represent an endorsement from us of this external content. We are not responsible for content found on external websites. If you are concerned about content found on external websites, please get in touch with the administrators of those sites.
7. Transactions
The only authentic record of Digital Asset transactions is the Blockchain
of that asset.
The PINT Software provides functionality that allows You to send Digital
Asset transfer instructions. Bitfia does not guarantee that transactions
You perform using the PINT Software shall be stored in any blockchain.
Digital Assets value is highly volatile and buying, selling, and holding Digital Assets involves a great deal of risk. PINT software cannot and does not guarantee the value of any Digital Assets. The Digital Assets consensus network verifies and confirms transactions that is submitted to them, and PINT software cannot and does not confirm, cancel, or reverse a transaction between two Digital Assets, but can only confirm the network’s completion of a transaction. The Digital Asset network is operated by a network of independent third parties. Transaction requests submitted to the Blockchain via the Service will automatically be completed or rejected by the network. PINT Software is not responsible for errors or omissions made by you or any third party in connection with any cryptocurrency transaction initiated via the it. The Service enables you to submit your transaction requests for confirmation to the network. PINT Software has no control over the network and cannot and does not ensure that any transaction request you submit via the Service will be completed. Transaction requests submitted via the Service may not be completed, or may be delayed, by the network. When you initiate a transaction request via the Service, you authorize us to submit your transaction request to the network in accordance with the directions you provide via the Service.
You must ensure that Your transactions conform to the applicable rules of
the software for the Digital Asset (especially with smart contract systems
like Ethereum).
Transaction/Mining Fee
There may be transaction fees (e.g. mining fees) associated with Digital Asset transactions that are required by the system You engage with. Bitfia shall not be responsible for any losses You incur due to transaction fees or losses that occur due to incorrectly setting transaction fees (i.e. too low or high).
Bitfia reserves the right to adjust the transaction fee. The same can transparently be seen in the PINT wallet application.
8. Limited Intellectual Property License
Bitfia licenses the PINT Software to You on a personal, non-exclusive, royalty-free, non-transferable, worldwide-basis, for the purpose of holding and transferring Digital Assets.
Under this license you may not:
This license shall automatically terminate if you violate any of these restrictions. It may also be terminated by Bitfia at any time at its own discretion. Bitfia also reserves the right to pursue firm legal action to protect our intellectual property in connection with the above restrictions.
9. Open Source Third Party Libraries
The PINT Software may contain libraries developed by third parties. Bitfia may provide third party libraries to You as part of the PINT Software solution but shall not be considered to be the owner or licensor of the third party libraries. Please refer to and respect the relevant third-party licenses.
10. Ideas and Feedback
If You choose to provide feedback on the features or functions of the PINT Software then You shall be deemed to have given permission to Bitfia to incorporate Your Feedback into the PINT Software. Bitfia shall be free to make use of Your Ideas and Feedback without royalty or obligation of any kind.
11. Specifically Disclaimed Risks
Using Digital Asset-related software necessarily entails many risks. Bitfia specifically disclaims and shall have no liability to You for the following risks:
a. operating system failures (mobile or desktop); and,
b. interactions between Your hardware, software and the PINT Software; and,
c. cloud backup software (e.g. certain Android distributions) may upload your private files/information to third party services; and,
d. malware, viruses or other malicious software on Your device that is able to take control of or interfere with the PINT Software; and,
e. communication delays between Your PINT Software and a node or relay service for a Digital Asset (and vice versa); and,
f. failure to achieve a certain market value/price for a Digital Asset, whether through a third-party service or any other kind of transaction (i.e. due to delays); and,
g. theft of Digital Assets.
12. No Warranty
The PINT Software is provided to You at no cost, “as-is” and without any warranty whatsoever expressed or implied, to the maximum extent permissible by law. Bitfia hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, Bitfia does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials or otherwise relating to such materials or on any websites or apps linked to this site.
IN NO EVENT SHALL BITFIA, ITS AFFILIATES AND SERVICE PROVIDERS, OR ANY OF THEIR RESPECTIVE OFFICERS, DIRECTORS, AGENTS, JOINT VENTURERS, EMPLOYEES OR REPRESENTATIVES, BE LIABLE FOR LOST PROFITS OR ANY SPECIAL, INCIDENTAL, INTANGIBLE, OR CONSEQUENTIAL DAMAGES, WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, ARISING OUT OF OR IN CONNECTION WITH AUTHORIZED OR UNAUTHORIZED USE OF THE PINT SOFTWARE SERVICES, OR THIS AGREEMENT. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
13. Third Party Service
SWAP Functionality by third party:
For your Digital Assets if you are using SWAP functionality, apart from the ‘send, receive and store’ service provided by PINT software, you acknowledge and agree that the transaction will be processed through a third-party exchange service.
PINT Software uses third-party service provided by Shapeshift through API to exchange cryptocurrencies. When depositing or transferring coins alternative to the main currency of your wallet you acknowledge and agree that the transaction will be processed through the third-party exchange service with additional fees for the transaction.
By using the Swap functionality, you agree to the terms of use of Shapeshift provided on the PINT software application.
14. Suspension, Termination, and Cancellation of Account
Bitfia may suspend, restrict, terminate or cancel your access to the Services due to:
15. Limitation of Liability
Bitfia's liability to You shall not, under any circumstances, exceed the
greater of:
a) the Singapore dollar value of 0.002 bitcoins; or,
b) 50 SGD.
Notwithstanding any term of this agreement, Bitfia shall not be liable for
any losses or damages that result from providing free technical support to
You.
16. Tax Liability
It is the user's responsibility to decide whether any taxes apply to the transactions you conduct through the PINT Services, and to withhold, report and remit the relevant funds to the appropriate tax authorities. You may view your transaction history in your PINT Account. Bitfia shall not be liable for any tax arising out of the transactions done by You in your local jurisdiction.
17. Indemnity
You agree to indemnify Bitfia against any claims, damages, losses or legal fees incurred due to Your use (or misuse) of the PINT Software.
18. Non-Waiver
No action or inaction of Bitfia shall be considered a waiver of any right or obligation by Bitfia.
19. Amendment
Bitfia may revise the Terms of this agreement for its website at any time without notice. However the same may be notified on the PINT Software application. By using the Service, you are agreeing to be bound by the current version of these Terms and Conditions of Use.
20. Assignment
You may not assign this agreement. Bitfia may assign this agreement upon 15 days notice.
21. Governing Law and Choice of Forum
This agreement shall be governed by the laws of Singapore. Any disputes related to this agreement or the PINT Software shall be heard in the courts of Singapore.
22. Our Privacy Policy
Our Privacy Policy is shared here after this agreement. Our Privacy Policy describes how we collect, use, and share your personal information. By accepting these Terms you also agree to our Privacy Policy.
23. Entire Agreement
This is the entire agreement between the parties and supersedes any other agreement, representations (or misrepresentations), or understanding, however communicated.
Privacy Policy
1. Principles:
a) Privacy is a human right and software should help protect your rights.
b) We don’t require you to register or log in when you are using wallet
functionality such as store, receive, send or swap (exchange) your
currencies.
c) We don’t have access to your funds (private keys).
d) We don’t require your name or email address.
2. Registration/Login Not Required
PINT does not require you to register or log in when are using wallet functionality such as store, receive, send or swap (exchange) your currencies. However, if you wish to use functionalities of Usage, or Buy or Sell, to be provided in future in PINT, you may need to provide information about you as per law of Singapore and your country of registration.
3. Private Keys Stay on Device
Your private keys will stay on your device.
4. Camera Data Stays on Device
Your camera will only be used for reading QR codes. Camera images will never leave your device.
5. Physical Location
Your physical location will never be communicated to us, unless you provide prior specific consent.
6. Blockchain Transactions
Your blockchain transactions may be relayed through servers (“nodes”) and will be publicly visible due to the public nature of distributed ledger systems.
7. Secure Communication with Our Servers
All of our servers support HTTPS.
8. Communication with Third-Party Servers
Exchange rates, balances, transactions and other blockchain information may be read from, or relayed to, third-party servers. We cannot guarantee the privacy of your Internet connection.
9. Third-Party Services
PINT has software integrations with third-party services that you may choose to use, for example, Shapeshift. If you do use third-party services through PINT then they will be clearly marked and there may be other terms or privacy policies that apply.
10. Aggregate Usage Statistics
We may collect PINT usage information in order to improve function or UI, but will only use this information in an aggregated, anonymized fashion, and never in association with your name, email, or other personally identifying information (Personally Identifying Information).
11. Extra Personally Identifying Information (PII)
You may choose to provide us with personally identifying information in order to participate in certain programs, activate features, or obtain other benefits but you will always be able to use the basic features of PINT without providing personally identifying information. If you provide us with personally identifying information then, notwithstanding any part of this policy, we may use that information in order to provide you with services or to improve the functioning or UI of PINT.
12. All User Information is Confidential
Your personally identifying information will be kept strictly confidential and never provided to third parties (other than in an aggregated, anonymized report such as number of users per month).
All Bitfia/PINT staff are bound by confidentiality agreements.
13. Support Requests
If you contact support then as part of the support request we may incidentally collect your personally identifying information but we will endeavor to keep that information secure and confidential. Support information may be managed using a third-party service and further terms of that service may apply to your support request.
